GENERAL TERMS AND CONDITIONS OF PARTICIPATION

For Package Travel Organized by Time Travel

PART I —GENERAL PROVISIONS

Section 1.Organizer

  1. The organizer of the Package is TIME TRAVEL Sp. z o.o., with its registered office at Al. Jerozolimskie 89/43, 02-001 Warsaw, Poland, entered in the National Court Register under KRS No. 0000735053, NIP 7010826828, REGON 380534431, hereinafter referred to as the “Organizer” or “Time Travel”.

  2. Time Travel is entered in the Register of Tour Operators and Traders Facilitating Linked Travel Arrangements maintained for the Mazowieckie Voivodeship under registration number 24128.

  3. The Organizer maintains the financial security and other protections required by applicable Polish law.

  4. Current contact details of the Organizer and, where required, an emergency or assistance contact shall be provided in the Booking documentation, My Trip or other information supplied for the relevant Tour.

Section 2.Scope of the Terms

  1. These General Terms and Conditions of Participation (“Terms”) apply to Package Travel organized by Time Travel and form part of the Agreement concluded for a specific Booking.

  2. The Agreement is governed by the version of these Terms accepted in connection with that Booking. A later amendment of the Terms does not automatically change Agreements already concluded.

  3. Specific conditions applicable to a particular Tour, Tour Departure or Booking may supplement these Terms and shall be identified before conclusion of the Agreement.

  4. Nothing in these Terms excludes or restricts any rights granted to a Traveler by mandatory provisions of applicable law.

Section 3.Contractual Documents

  1. The contractual conditions applicable to a Booking may consist of:

    1. the Individual Agreement or Booking Confirmation containing the individual terms of the Booking;

    2. these Terms;

    3. the contractual Tour Description applicable to the selected Tour Departure;

    4. the applicable Price Breakdown;

    5. information concerning Mandatory Additional Payments and selected Optional Services;

    6. the statutory information provided before conclusion of the Agreement; and

    7. any other document expressly identified as forming part of the Agreement.

  2. Conditions specifically agreed for an individual Booking prevail over general provisions to the extent permitted by applicable law.

  3. General advertising content, promotional slogans, photographs and other illustrative materials do not independently extend the scope of the Agreement unless they describe a characteristic that forms part of the contractual Tour information or is otherwise binding under applicable law.

Section 4.Separate Legal Documents

  1. The Organizer may provide separate legal documents, including:

    1. the Privacy Policy or Privacy Notice;

    2. the Electronic Services Regulations governing the Website, account and My Trip;

    3. the Cookie Policy;

    4. insurance conditions; and

    5. other legally required notices.

  2. Such documents have the legal function resulting from their subject matter and do not automatically become part of the Package Travel Agreement merely because they are made available during the Booking Process.

Section 5.Applicable Law

  1. The Agreement is governed by Polish law, in particular the applicable legislation concerning package travel and linked travel arrangements.

  2. Mandatory consumer and Traveler rights remain applicable irrespective of any provision of the Agreement.

Legal Revision means the identifiable version of these Terms or another version-controlled contractual document applicable to a particular Booking.

Mandatory Additional Payment means an additional mandatory cost connected with the Package that is disclosed separately where permitted by applicable law.

Traveler means a person seeking to conclude an Agreement or entitled to travel under an Agreement within the meaning of applicable package travel legislation.

PART III —BOOKING AND ELECTRONIC CONTRACT FORMATION

Section 7.Information Before Booking

  1. Before the Contracting Person completes a Booking with an obligation to pay, the Booking Platform provides the material information applicable to the selected Tour and Tour Departure.

  2. The Booking information includes the characteristics, price, payment conditions and other information required by applicable law for the relevant Tour.

  3. Where a particular Tour is subject to additional legally required information or conditions, those details are stated in the Tour information, Booking summary, Individual Agreement or other contractual information applicable to that Booking.

  4. The information applicable to the specific Tour Departure selected during the Booking Process forms the basis of the Booking.

Section 8.Online Booking

  1. A Booking may be made through the Booking Platform by selecting the Tour, Tour Departure, number of Travelers, required Traveler information and available additional services.

  2. Before submitting the Booking, the Contracting Person shall be able to review the selected services, Travelers, price and other material Booking information.

  3. The Contracting Person is responsible for checking the accuracy of the information entered before submitting the Booking.

  4. The exact Booking steps may vary depending on the Tour, transport model or services selected.

Section 9.Final Booking Summary and Obligation to Pay

  1. Immediately before the final action creating an obligation to pay, the Booking Platform shall clearly display the principal characteristics of the Booking and the amount payable.

  2. The final Booking action shall clearly indicate that submission creates an obligation to pay.

  3. Where immediate payment is required, the Booking Platform may use wording such as “Confirm & Pay”, “Book & Pay” or another equivalent expression clearly indicating the payment obligation.

Section 10.Conclusion of the Agreement

  1. The Agreement is concluded when:

    1. the Contracting Person has completed the required Booking information;

    2. the required contractual information and documents have been made available;

    3. the Contracting Person has completed the required electronic acceptance;

    4. the final Booking action with an obligation to pay has been performed;

    5. the required Prepayment or, where applicable, the full Contract Price has been successfully paid; and

    6. the Booking Platform has electronically confirmed the Booking.

  2. An unsuccessful, declined, cancelled or interrupted payment does not complete the Booking and does not result in conclusion of the Agreement.

  3. After conclusion of the Agreement, the Booking is assigned a unique Booking reference and is made available through My Trip.

Section 11.Booking Confirmation and Tour Confirmation

  1. Booking Confirmation confirms that the Booking has been successfully created and, where applicable, that the Agreement has been concluded.

  2. Booking Confirmation does not mean that the relevant Tour Departure has already reached the operational status of Tour Confirmed.

  3. A Tour may remain Pending Confirmation after the Agreement has been concluded, including where the relevant Tour requires a minimum number of participants.

  4. Tour Confirmed means that, based on the information, participant numbers and operational conditions available at that time, the Organizer has confirmed the planned operation of the relevant Tour Departure.

  5. Tour Confirmed status is not an unconditional guarantee that the Tour can never subsequently be changed or cancelled. Lawful changes, unavoidable and extraordinary circumstances and any other circumstances in which modification or termination is permitted by the Agreement or mandatory applicable law may still affect the Tour.

  6. Where a minimum number of participants applies, the applicable minimum and any information required by mandatory law are stated in the contractual information for the relevant Tour or Booking.

Section 12.Electronic Acceptance and Legal Revision

  1. Required contractual documents shall be made available before conclusion of the Agreement.

  2. Acceptance may be provided electronically, including by checkbox or another affirmative electronic action.

  3. Contractual acceptance shall be separate from consents that require an independent decision, including marketing consent or consent to use a Traveler’s image.

  4. The Organizer shall record the version of the Terms and other version-controlled contractual documents applicable to the Booking.

  5. A later version of the Terms does not automatically replace the version accepted for an existing Booking.

  6. After conclusion of the Agreement, the Organizer shall make the Agreement or confirmation of the Agreement available to the Contracting Person through My Trip in a form satisfying the requirements of a Durable Medium under applicable law.

  7. The contractual documents applicable to the Booking shall remain accessible in My Trip in the version recorded for that Booking and shall not be replaced by later versions of the Terms, Tour Description or other contractual documents.

Section 13.Technical, Pricing and Calculation Errors

  1. The Organizer takes reasonable measures to ensure that prices, Discounts, availability, payment amounts and other information displayed or calculated by the Booking Platform are accurate.

  2. In the event of an obvious and material technical, pricing or calculation error, including an incorrect Tour price, Discount, number of Travelers, payment amount or another essential Booking parameter, the Organizer may correct the error.

  3. If the error is identified before conclusion of the Agreement, the affected Booking may be corrected or cancelled before completion.

  4. If such an error is identified after conclusion of the Agreement, the Organizer shall inform the Contracting Person without undue delay.

  5. Where the error materially affected the Agreement and cannot reasonably be corrected while preserving the intended contractual conditions, the Organizer may, to the maximum extent permitted by mandatory applicable law, cancel the affected Booking and refund all amounts paid in connection with that Booking.

  6. The Organizer shall not rely on this Section merely because an agreed price later becomes commercially unfavorable or because prices or promotions subsequently change.

PART IV —CONTRACTING PERSON AND TRAVELERS

Section 14.Contracting Person

  1. Each Booking identifies one Contracting Person who submits and manages the Booking.

  2. The Contracting Person may book:

    1. only for themselves;

    2. for themselves and other Travelers; or

    3. for other Travelers without personally participating in the Tour.

  3. The Contracting Person provides accurate contact details and serves as the primary administrative contact for the Booking unless otherwise agreed.

  4. Unless expressly agreed otherwise, the Contracting Person is responsible for payment of all amounts due under the Booking, including amounts relating to other Travelers included in that Booking.

  5. Operational communications addressed to the Contracting Person are treated as communications relating to the Booking, without limiting any requirement under applicable law to communicate directly with a particular Traveler.

  6. The designation of a Contracting Person does not limit the mandatory rights of any Traveler included in the Booking.

Section 15.Booking for Other Travelers

  1. By including another person in the Booking, the Contracting Person confirms that they are authorized to provide the information reasonably necessary to create and manage the Booking for that person.

  2. The Contracting Person is responsible for passing material information concerning the Tour, Booking and participation conditions to the other Travelers.

  3. Where applicable law requires an individual Traveler’s own consent or declaration, the Contracting Person’s acceptance shall not replace that Traveler’s separate consent.

  4. In particular, separate consent may be required for marketing communications, use of image or likeness, or other matters that cannot lawfully be accepted on another Traveler’s behalf.

Section 16.Traveler Information

  1. The information required for each Traveler may vary depending on the Tour, destination, transport, accommodation, insurance or other services.

  2. The minimum information required at Booking may include:

    1. first name;

    2. last name; and

    3. date of birth.

  3. Where necessary, the Organizer may additionally require information such as nationality, passport or ID details, document expiry date, insurance data, emergency contact details or other information required for performance of the Package.

  4. Individual fields may be designated by the Booking Platform as Required, Optional or Not Required for the relevant Tour.

  5. Information not required during the initial Booking may be requested later where reasonably necessary for ticketing, insurance, accommodation, border requirements or other elements of the Package.

Section 17.Accuracy and Changes to Traveler Information

  1. The Contracting Person and each Traveler are responsible for ensuring that information provided to the Organizer is accurate and consistent with the relevant official documents.

  2. Where incorrect information causes actual additional costs, including ticket reissue, airline charges, insurance changes or supplier fees, the Organizer may require reimbursement of those reasonable costs.

  3. Correction of a simple data-entry error shall not automatically be treated as cancellation or replacement of the Traveler.

  4. Replacement of one Traveler by another person is governed by the provisions concerning transfer or change of Traveler.

Section 18.Completion of Information After Booking

  1. The Organizer may allow or require additional Traveler information to be completed after conclusion of the Agreement.

  2. Such information may be provided through My Trip, email or another secure electronic method.

  3. Where the information is necessary for performance of the Package, the Organizer may specify a reasonable deadline for its submission.

  4. Failure to provide necessary information within the communicated deadline may affect the Organizer’s ability to provide the relevant service and may result in actual additional costs or other consequences arising from that failure.

Section 19.Minors

  1. Minors may participate subject to the conditions of the relevant Tour and applicable law.

  2. The Organizer may require information concerning the minor, parent or legal guardian, accompanying adult and emergency contact.

  3. Where required, the Organizer may request parental authorizations or other documents necessary for travel, accommodation, transport or border formalities.

  4. Responsibility for ensuring that the minor possesses legally required travel documents remains with the parent, legal guardian or other person responsible for the minor.

Section 20.Special Requirements, Fitness to Travel and Dietary Needs

  1. Travelers should inform the Organizer as early as reasonably possible of any special requirement relevant to participation in the Tour.

  2. Such requirements may include reduced mobility, accessibility needs, dietary requirements or other circumstances requiring specific arrangements.

  3. A special request becomes contractually binding only if it has been expressly accepted by the Organizer.

  4. A general preference or unconfirmed request does not constitute a guaranteed service.

  5. Standard group Tours may involve customary walking pace, prolonged walking, stairs, uneven surfaces, outdoor conditions and other normal physical activity appropriate to sightseeing travel.

  6. Each Traveler is responsible for assessing whether they are physically and medically able to participate and for obtaining medical advice where appropriate.

  7. Dietary preferences or requests, including vegetarian, vegan, halal, gluten-free or similar requirements, may be communicated to the relevant provider but are not guaranteed unless expressly confirmed.

  8. Unless expressly guaranteed for a specific service, the Organizer and third-party catering providers do not guarantee a sterile or completely allergen-free environment, including protection from cross-contamination at buffets, shared kitchens or group meal venues.

  9. Travelers with serious allergies or medical dietary requirements remain responsible for taking appropriate personal precautions and informing the relevant provider directly where necessary.

PART V —TOUR INFORMATION AND CONTRACTUAL CONDITIONS

Section 21.Tour Information and Contractual Record

  1. The Tour Description and final Booking Summary identify the material characteristics of the relevant Tour, including destination, dates, principal services, transport model, accommodation model, included services, required payments and material Tour-specific conditions.

  2. Information expressly recorded for the Booking prevails over general promotional content. The Booking record and Legal Revision preserve the contractual information applicable to that Booking.

  3. Tour-specific conditions shown before Booking form part of the Agreement and prevail over general provisions only for the matter they specifically regulate.

Section 22.Photographs and Illustrative Content

  1. Photographs, videos, maps, graphics and similar materials are illustrative unless a specific characteristic is expressly confirmed as part of the Booking.

  2. They do not guarantee identical weather, seasonal decoration, crowds, room appearance, view, snow, sea conditions, vehicle appearance or other non-contractual visual circumstances.

  3. The written contractual information recorded for the Booking controls in the event of inconsistency.

Section 23.Program, Itinerary, Local Availability and Free Time

  1. The itinerary describes the principal structure and material elements of the Tour.

  2. Unless a particular time, order, day, venue or opening is expressly guaranteed as material, the Organizer may reasonably change sequence, timing, route or operational organization because of transport, weather, safety, availability, local conditions, opening arrangements or similar circumstances.

  3. Restaurants, shops, cafés, markets, Christmas markets, museums, attractions, beaches and other third-party or public venues may change hours, close, operate partially or impose access restrictions for reasons outside the Organizer's direct control. Their unavailability does not by itself constitute improper performance unless the relevant service was expressly guaranteed as a material included service.

  4. During designated free time, Travelers act independently. The Tour Leader is not required to accompany individual Travelers, arrange private leisure, make restaurant reservations, provide continuous translation or supervise independent activities.

  5. Independent purchases, meals, transport or activities during free time are outside the Package unless expressly stated otherwise.

Section 24.Included, Mandatory and Optional Services

  1. Only services expressly identified as included form part of the Contract Price.

  2. Mandatory additional payments, if any, are stated before conclusion of the Agreement and must be paid as required for the relevant Tour.

  3. Optional services are not included unless separately selected and confirmed.

Section 25.Contract Price and Promotions

  1. The Contract Price is the price shown for the selected Tour and Booking configuration before conclusion of the Agreement.

  2. Prices may vary between departure dates, sales channels, booking dates, promotions, room types, occupancy, availability or commercial offers. A Traveler is not entitled to another person's price merely because the same or a similar Tour was sold at a different price.

  3. Discounts and promotions apply only under the conditions stated for them and do not apply retroactively unless expressly stated.

Section 26.Price Stability After Conclusion

  1. Once the Agreement is concluded, the Contract Price recorded for the Booking remains fixed except for an obvious technical/pricing error handled under these Terms, a change requested or accepted by the Contracting Person, later purchase of an Optional Service, or an adjustment directly required or permitted by mandatory law.

  2. The Organizer does not reserve a general contractual right to increase the Contract Price merely because its own operating costs later increase.

Section 27.Currency and PLN Conversion

  1. Unless expressly stated otherwise, Tour prices are denominated in EUR.

  2. Where payment in PLN is offered, the contractual conversion rate is 1 EUR = 4.50 PLN, unless a different rate is expressly displayed for the relevant Booking before payment.

  3. Payment in PLN does not change the underlying EUR pricing currency of the Tour.

Section 28.Mandatory Additional Payments

  1. A mandatory additional payment is not an Optional Service and must be paid where it forms part of the conditions of the relevant Tour.

  2. Such payments are disclosed before conclusion of the Agreement where required by law.

  3. Failure to make a mandatory payment may result in non-provision of the affected service, inability to participate or other consequences permitted by the Agreement and mandatory law.

Section 29.Optional Services

  1. Optional excursions, activities, upgrades and other add-ons are not included in the Contract Price unless expressly stated otherwise.

  2. An Optional Service becomes part of the relevant transaction only after it is selected, available, confirmed and, where required, paid.

  3. Its displayed price is the final customer price for that service and may include organization, reservation, coordination, administration and commercial margin. The Organizer is not required to disclose internal supplier rates or margin unless mandatory law expressly requires it.

  4. Cancellation or non-performance of an Optional Service does not automatically cancel, reduce or otherwise alter the basic Package.

  5. Where Time Travel has accepted payment for a separately priced Optional Service and arranged or facilitated that service, any financial settlement resulting from its non-performance concerns only the amount paid for that specific Optional Service, subject to the applicable conditions and mandatory law.

  6. Where the Optional Service cannot be provided because of weather, safety conditions, provider unavailability, illness of the guide or instructor, insufficient operating conditions or another circumstance affecting that service, Time Travel may first offer a reasonable replacement, rescheduling or alternative where available.

  7. If no reasonable replacement or rescheduling is available and the paid Optional Service is not provided, the amount paid to Time Travel for that specific Optional Service is settled separately from the basic Package in accordance with the applicable conditions and mandatory law.

Section 30.Weather-Dependent and Independently Purchased Optional Services

  1. Weather-dependent Optional Services, including activities such as snowmobile rides, husky or reindeer activities, boat trips or similar experiences, may be modified, postponed, relocated, replaced or cancelled because of weather, snow or ice conditions, visibility, safety requirements, natural conditions, authority decisions, provider decisions or provider unavailability.

  2. Such circumstances affect the Optional Service only and do not by themselves affect the Contract Price or validity of the basic Package.

  3. Where the Traveler purchased and paid for the Optional Service through Time Travel, the rules in Section 29 apply.

  4. Where the Traveler purchases an excursion, attraction, activity or other service independently and directly from a third-party provider, the contract for that service is concluded directly between the Traveler and that provider.

  5. In such an independent purchase, any change, cancellation, refund, complaint or other financial settlement is handled directly between the Traveler and the third-party provider. Time Travel is not a party to that transaction and is not responsible for obtaining a refund or conducting the claim on the Traveler's behalf, except where mandatory law provides otherwise.

Section 31.Payment and Conclusion of the Booking

  1. A Booking is completed only after the required payment has been successfully made and the platform issues confirmation.

  2. Successful payment and platform confirmation conclude the Agreement, generate the Booking ID and make the Booking available in My Trip.

  3. Starting or completing a booking form without the required successful payment does not reserve a place unless the Organizer expressly confirms otherwise.

Section 32.Prepayment and Remaining Balance

  1. The Booking Summary states whether a Prepayment, full payment or other payment structure applies.

  2. Where a Prepayment is permitted, the Remaining Balance must be paid within the deadline shown for the Booking.

  3. The Prepayment forms part of the Contract Price and is not a separate service fee unless expressly stated otherwise.

Section 33.Payment Methods and Additional Payments

  1. Available payment methods are displayed during the booking or payment process. Payment is effective when successfully credited or confirmed through the relevant payment system.

  2. Optional and mandatory additional services may require separate payment and separate deadlines or conditions.

  3. Flight-ticket intermediation is governed separately by the air-travel provisions.

Section 34.Failure to Pay

  1. Failure to pay the Remaining Balance or another amount due does not retroactively invalidate an already concluded Agreement.

  2. The Organizer may request payment, set an additional reasonable deadline where appropriate and, where legally justified, terminate the Agreement or withhold the affected additional service.

  3. Amounts lawfully due remain payable until paid, cancelled or otherwise settled under the Agreement or mandatory law.

Section 35.Changes Requested by the Contracting Person

  1. A request to change a Booking is subject to availability, supplier conditions, operational feasibility and any applicable cost.

  2. No requested change is effective until expressly confirmed by the Organizer and recorded for the Booking.

  3. Any additional amount resulting from an approved change must be paid as communicated.

Section 36.Traveler Data Corrections and Transfer

  1. Traveler data must match the required travel documents.

  2. Corrections and replacement of a Traveler are subject to applicable law, supplier conditions, deadlines, availability and actual additional costs.

  3. Where mandatory law permits transfer of the Package to another Traveler, the Organizer may require the information and payment necessary to carry out that transfer.

Section 37.Named Third-Party Services and Effect of Changes

  1. A name change may be impossible or costly where a hotel, ticket, admission, airline, transport or other supplier has already created a named or non-transferable reservation.

  2. An approved Booking change affects only the elements expressly confirmed as changed. All other contractual terms remain unchanged.

Section 38.Coach Transport and Departure Points

  1. Coach transport may be provided by the Organizer or by an external licensed carrier.

  2. Departure and arrival times may be approximate where expressly indicated and may change due to traffic, border controls, weather, road conditions, driver-hours regulations or other operational circumstances.

  3. The Organizer may reasonably adjust the route, stops, timing or operational sequence of transport where necessary for safety, availability or proper performance of the Tour.

  4. Where direct departure from a selected city becomes unavailable or impracticable for operational, technical, safety or transport reasons, the Organizer may arrange transport from that city to another departure or meeting point.

  5. Such connecting transport may be provided by train, scheduled bus, minibus, van, passenger car, taxi, another coach, the Organizer's own transport or a combination of suitable transport methods.

  6. Where the Organizer arranges such replacement or connecting transport because the originally planned departure cannot reasonably be provided, the Organizer bears the cost of the arranged replacement connection unless otherwise required by mandatory law.

  7. A transfer or connection may involve a reasonable waiting period between transport services. Such waiting time does not by itself constitute non-performance of the Package where the onward transport is reasonably organized and the Tour can continue.

  8. The exact boarding point may also be changed within the same city or reasonable local area where operationally necessary, provided that updated information is communicated before departure.

  9. Auxiliary onboard amenities, including Wi-Fi, USB or 230V charging sockets, entertainment systems and similar comfort features, are not guaranteed unless expressly stated as a material contractual feature of the relevant Tour.

  10. Reduced charging speed, mobile-network dead zones, limited Wi-Fi performance, temporary technical unavailability of comfort systems or similar auxiliary limitations do not by themselves constitute improper performance of the transport service.

  11. Cabin temperature may vary according to weather, vehicle design, passenger load and operational conditions and is not individually adjustable for each Traveler.

Section 39.Coach Seats

  1. Coach seats may be:

    1. assigned operationally by the Organizer;

    2. selected as a preference; or

    3. purchased as a paid seat-selection service, where available.

  2. A seat number or position may be changed where reasonably required by a change of vehicle, seating configuration, safety requirements, group organization or other operational circumstances.

  3. Where reasonably possible, the Organizer will maintain a seat in a comparable area of the coach.

  4. A selected or assigned seat may be moved within a reasonable range, commonly including approximately one or two rows forward or backward. A greater change may be necessary where the replacement vehicle has a different seating layout, where seats are unavailable, or where safety or operational requirements make a closer allocation impracticable.

  5. Where an exact paid seat cannot be maintained, Time Travel may make an appropriate operational adjustment concerning that seat-selection service. Such a change does not by itself affect the Contract Price or validity of the basic Package.

Section 40.Breakdown and Transport Disruption

  1. In the event of a coach breakdown, accident, technical failure or other disruption affecting the planned transport, the Organizer shall take reasonable steps to restore transport or arrange substitute transportation as soon as reasonably possible.

  2. Depending on the circumstances, organization of substitute transportation may require up to 24 hours.

  3. The 24-hour period is an operational response framework and does not exclude any mandatory rights of Travelers under applicable law.

  4. During this period, the Organizer may modify the timing or sequence of the Tour where reasonably necessary to continue performance of the Package.

Section 41.Substitute Transportation

  1. Where the originally planned transport cannot reasonably be used or provided, the Organizer may arrange another suitable means of transport.

  2. Substitute transportation may include:

    1. another coach;

    2. one or more minibuses or vans;

    3. scheduled bus;

    4. train;

    5. passenger vehicle;

    6. taxi;

    7. air transport; or

    8. a combination of different transport methods.

  3. One larger vehicle may be replaced by several smaller licensed vehicles, or several vehicles by another suitable vehicle, where reasonably necessary.

  4. The choice of substitute transport and allocation of Travelers is determined operationally by the Organizer, taking into account safety, availability, luggage, route, group size, timing and continuation of the Tour.

  5. A change of vehicle type, number of vehicles, route to the main departure point or reasonable waiting time between connections does not by itself constitute improper performance of the Package where the agreed transport function remains safely and reasonably provided.

  6. This Section applies to the maximum extent permitted by mandatory applicable law.

Section 42.Missed Departure and Punctuality

  1. Travelers are responsible for arriving at the designated departure or meeting point within the time communicated by the Organizer.

  2. Where a Traveler fails to appear on time, the Organizer is not required to delay the departure of the entire group where doing so would materially disrupt the Tour or transport schedule.

  3. Services missed because of lateness attributable to the Traveler are treated as unused for reasons attributable to the Traveler and are subject to the applicable cancellation and settlement rules.

  4. Any additional cost of joining the group later shall be borne by the Traveler unless the missed departure resulted from circumstances for which the Organizer is legally responsible.

  5. Travelers arranging independent onward transport after the scheduled return of a Tour are responsible for allowing a reasonable time margin for traffic, border controls, weather and other foreseeable travel delays. Costs arising from an independently arranged connection missed for reasons for which the Organizer is not legally responsible remain with the Traveler.

Section 43.Safety, Conduct and Onboard Facilities

  1. Travelers are required to comply with safety instructions issued by the driver, Tour Leader or other authorized personnel.

  2. Seat belts must be used where provided and required by law.

  3. Smoking, including electronic cigarettes, and consumption of alcohol in the vehicle may be prohibited in accordance with the rules communicated for the relevant transport.

  4. Conduct that seriously threatens safety or materially disrupts the journey may result in measures provided for elsewhere in these Terms and applicable law.

  5. Where a coach is equipped with an onboard chemical toilet, its use may be temporarily restricted for technical, sanitary, safety, servicing or freezing-weather reasons.

  6. Temporary unavailability of an onboard toilet between service stops does not by itself constitute improper performance of the transport service where reasonable alternative toilet stops are provided when operationally possible.

Section 44.Local Transport by Cars and Small Vehicles

  1. Certain Tours, including island, small-group and destination-based Tours, may use passenger cars, vans, minibuses or similar vehicles for local transport.

  2. Such vehicles are driven only by a driver, accompanying person or other person authorized by the Organizer or the relevant transport provider. Travelers are not entitled to drive the vehicle, take possession of the vehicle or keys, replace the designated driver, or use the vehicle independently unless self-drive use is expressly offered for a specific Tour.

  3. The Organizer determines the allocation of Travelers between vehicles, taking into account capacity, safety, luggage, route, operational requirements and group organization.

  4. A Traveler is not entitled to select a specific vehicle, driver, accompanying person or group of co-passengers unless this has been expressly confirmed as part of the Booking.

  5. Vehicle and passenger allocation may be changed during the Tour where reasonably necessary for operational, safety, route, luggage or group-management reasons.

  6. Use of several vehicles instead of one common vehicle, or redistribution of Travelers between vehicles, does not by itself constitute improper performance of the Package where the agreed transport function remains safely and reasonably provided, to the maximum extent permitted by mandatory applicable law.

PART XI —AIR TRAVEL

Section 45.General Air-Tour Model

  1. Unless expressly required by mandatory law to be treated otherwise, air transport is not included in the Contract Price of Time Travel's Package and is not sold as an included component of the basic Tour.

  2. Travelers participating in an air Tour are responsible for arranging and paying for their air transport independently, except where Time Travel separately offers flight-ticket intermediation in accordance with Section 47.

  3. The Tour Description and Booking information identify the meeting point, commencement of Time Travel's Package services and any recommended arrival or departure parameters.

  4. The price shown for the Tour does not include the cost of independently purchased air tickets.

Section 46.Flights Purchased Independently by the Traveler

  1. Where the Traveler purchases air transport independently, the flight contract is concluded directly between the Traveler and the airline, booking platform or other relevant provider.

  2. The Traveler is responsible for selecting flights that allow sufficient time to reach the stated meeting point and for all costs relating to the ticket, baggage, check-in, changes, cancellation, missed flights or other airline charges.

  3. Unless expressly stated otherwise, Time Travel's Package services begin at the meeting point and time stated for the Tour.

  4. A delay, cancellation, missed connection, denied boarding or other disruption affecting an independently purchased flight does not by itself constitute non-performance by Time Travel.

  5. If the Traveler arrives late, arrives on a later day, misses the first day or another part of the Tour, or cannot reach the meeting point because of independently arranged air or other transport, the missed services are treated as missed for reasons outside Time Travel's responsibility unless mandatory law provides otherwise.

  6. Time Travel is not required to repeat, reschedule or privately reproduce program elements missed because of the Traveler's independently arranged transport.

  7. Any additional cost of joining the group later, including local transport, accommodation, meals or transfers required to catch up with the group, is borne by the Traveler unless the underlying delay results from a service for which Time Travel is legally responsible.

  8. Time Travel is not responsible for reimbursement of independently purchased air tickets or for losses resulting from independently arranged flight disruption where the flight is not a service for which Time Travel is legally responsible, to the maximum extent permitted by mandatory applicable law.

Section 47.Separate Flight-Ticket Intermediation Within Europe

  1. For Tours within Europe and only where this option is expressly offered for the relevant Tour or requested by the Traveler, Time Travel may provide a separate ticket-purchase intermediation service.

  2. The air ticket and the amount paid for it are financially separate from the Contract Price, Prepayment and Remaining Balance of the basic Tour.

  3. Time Travel proceeds with the ticket purchase only after receiving the full separate amount required for the flight.

  4. Payment for the Tour does not constitute payment for the flight. No obligation to arrange or issue a ticket arises until the separate flight amount has been successfully received and the requested fare remains available.

  5. Airline fares, baggage conditions and availability may change until the ticket is actually issued. If the originally indicated fare is no longer available, the Traveler may be asked to approve and pay the new fare before issuance.

  6. Basic or low-cost airline fares may include random seat assignment and strict baggage dimensions or allowances. Adjacent seating for Travelers, specific seat placement or additional cabin/checked baggage are not guaranteed unless the relevant paid airline service has been expressly selected, confirmed and paid for before ticket issuance.

  7. After the ticket has been issued, the transport contract is governed by the airline's applicable fare and carriage conditions. Changes, cancellations, name corrections, baggage additions, refunds, compensation requests and other post-issuance matters are handled directly by the Traveler with the airline or relevant ticket provider unless Time Travel expressly agrees to provide separate assistance.

  8. Time Travel does not undertake to contact the airline, conduct refund or compensation proceedings, submit claims, appeals or complaints, or negotiate with the airline on the Traveler's behalf after ticket issuance, except to the extent that a mandatory legal obligation applies.

  9. Airline tickets may be non-refundable or subject to significant cancellation or change restrictions. The possibility and amount of any refund depend on the airline's fare rules and mandatory applicable law.

  10. If an airline or ticket provider actually returns funds to Time Travel in relation to the Traveler's ticket, such funds are settled with the Traveler in accordance with the provider's conditions and mandatory applicable law.

  11. Time Travel remains responsible for its own booking or transmission errors only to the extent required by mandatory applicable law.

  12. The separately arranged air ticket does not become part of the advertised Contract Price of the basic Tour merely because Time Travel facilitated its purchase. Its legal classification remains subject to mandatory package-travel or linked-travel-arrangement law based on the actual sales arrangement.

Section 48.Flights Outside Europe

  1. For Tours outside Europe or outside the geographical scope in which Time Travel is permitted to provide flight-purchase assistance, Time Travel does not purchase, issue or arrange air tickets for Travelers.

  2. Travelers purchase and pay for such flights independently and enter into the relevant transport contract directly with the airline or other ticket provider.

  3. The Contract Price of a Time Travel Tour outside Europe does not include air transport unless mandatory law requires a different legal classification based on the actual arrangement.

  4. Recommendations concerning suitable flights, arrival times or airports are provided for practical coordination only and do not make Time Travel a party to the Traveler's independently purchased air-transport contract.

Section 49.Independent Arrival, Connections and Meeting at Destination

  1. Travelers arranging their own flights or other transport to the destination are responsible for allowing sufficient time for delays, cancellations, border formalities, baggage collection, transfers and other foreseeable disruptions.

  2. Time Travel is not required to delay the commencement of group services indefinitely because an individual Traveler's independently arranged transport is delayed.

  3. Any reasonable additional cost of joining the group later is borne by the Traveler unless the delay results from a service for which Time Travel is legally responsible.

  4. Services missed before the Traveler joins the group do not automatically give rise to a refund where the absence results from independently arranged transport.

  5. Where a recommended flight or arrival option is communicated by Time Travel, that recommendation does not constitute a guarantee of the airline's operation, punctuality or continued availability unless Time Travel is legally responsible for that flight under mandatory law.

PART XII —TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

Section 50.Travel Documents

  1. Each Traveler is responsible for possessing valid and original travel documents required for the entire journey, including any passport, identity document, visa, residence permit or other document required for entry, transit, stay and return.

  2. Travelers are responsible for ensuring that their documents remain valid for all countries included in or crossed during the Tour.

  3. Before conclusion of the Agreement, the Organizer shall provide the general passport, visa, entry and health-formality information required by applicable law. Such general information does not replace the Traveler’s responsibility to verify requirements applicable to their nationality, residence status and individual circumstances.

  4. Each Traveler is responsible for ensuring that items carried across borders comply with customs, security, agricultural, currency, medication and other applicable restrictions. Fines, confiscations, delays or other consequences arising exclusively from a Traveler's prohibited or undeclared items remain attributable to that Traveler.

Section 51.Foreign Nationals, Temporary Protection and Residence Status

  1. Travelers who do not hold Polish citizenship are responsible for verifying whether their individual documents and status permit them to:

    1. leave Poland;

    2. enter each destination country;

    3. transit through every country on the route; and

    4. lawfully return to Poland or another country of residence.

  2. A document or immigration status permitting lawful stay in Poland does not necessarily constitute a valid border-crossing, transit or entry document for another country.

  3. This applies in particular to temporary protection, PESEL UKR or similar status, residence permits, documents extended under special legislation, pending-residence stamps, certificates, electronic confirmations or mobile-application documents, and other temporary or special residence arrangements.

  4. The Traveler is solely responsible for verifying the cross-border validity of such status or documents with the competent authorities or consular services for each destination and transit country.

  5. The Organizer does not provide individual legal or immigration advice and acceptance of a Booking does not constitute verification or confirmation of the Traveler's individual right to cross any border.

Section 52.Refusal of Boarding, Entry or Continuation of Travel

  1. If a Traveler is refused boarding, refused entry, removed from transport, required to leave a vehicle, detained by border or immigration authorities or otherwise prevented from continuing the Tour for reasons relating exclusively to that Traveler's documents, visa, immigration status, prohibited items or legal right to travel, the circumstances are treated as attributable to the Traveler.

  2. To the maximum extent permitted by mandatory applicable law, the Organizer is not responsible for losses, additional costs or unused services resulting from such Traveler-side circumstances unless the situation was caused by incorrect information or another circumstance for which the Organizer is legally responsible.

  3. The Organizer is not required to delay the entire group for an indefinite period while an individual Traveler's document, customs, police, border or immigration issue is being resolved.

  4. Where continuation with the group is no longer possible, the Traveler bears the costs of joining the group later, onward travel or returning home, unless mandatory law provides otherwise.

  5. Removal from transport or refusal of entry for Traveler-side reasons does not by itself create a contractual right to compensation or a refund outside the cancellation and settlement rules applicable to the Booking.

Section 53.Unused Services for Reasons Attributable to the Traveler

  1. Where a Traveler is unable or chooses not to use all or part of the Package for reasons attributable exclusively to that Traveler, including lack of valid documents, refusal of entry, lateness, voluntary non-participation or similar personal circumstances, the unused service is treated as unused for reasons on the Traveler's side.

  2. Such circumstances do not by themselves create a contractual right to a refund or other financial adjustment.

  3. Any mandatory consequence that cannot lawfully be excluded is governed directly by applicable law.

Section 54.Traveler Responsibility Before Departure

  1. Travelers should verify their documents and entry requirements sufficiently in advance of departure.

  2. The Organizer may request copies or details of travel documents where reasonably necessary for ticketing, insurance, passenger lists, accommodation or border procedures.

  3. Acceptance of a Booking does not constitute confirmation by the Organizer that the Traveler’s individual documents or immigration status are legally sufficient for the journey.

  4. The Organizer may refuse participation where it is clear that a Traveler lacks a document legally required to undertake the journey.

PART XIII —ACCOMMODATION AND BAGGAGE

Section 55.Accommodation

  1. Accommodation is provided in accordance with the conditions stated for the relevant Tour.

  2. Depending on the Tour and group format, accommodation may be provided in hotels, apartments, villas, holiday homes or other accommodation identified in the Tour Description.

  3. Small-group and destination-based Tours may use villas, apartments or similar properties consisting of several bedrooms and shared common areas.

  4. Where villa, apartment or shared accommodation is stated for the Tour, bedrooms, bathrooms, kitchens, living areas and other facilities may be shared by several Travelers. The number of bedrooms, bathrooms and occupants per room may vary according to the property and the accommodation configuration disclosed for the relevant Tour.

  5. Photographs of accommodation are illustrative unless a specific property, room type or configuration is expressly identified as contractually guaranteed.

  6. Where reasonably necessary for operational reasons, the Organizer may replace the originally planned accommodation with another property of a comparable or higher overall standard or appropriate character, subject to applicable law.

  7. Travelers are required to comply with the rules of the accommodation provider and may be held financially responsible for damage caused by them.

  8. Hotel categories and star ratings are assessed according to the rules and standards applicable in the destination country and may differ from standards customarily used in Poland or another country.

  9. Personal hotel charges, including minibar, room service, refundable deposits, damages or services not included in the Package, are borne directly by the Traveler.

Section 56.Room and Accommodation Allocation

  1. The Organizer determines the allocation of Travelers between rooms, bedrooms, apartments, villas and other accommodation units in accordance with the accommodation model applicable to the Tour.

  2. Unless expressly confirmed as part of the Booking, Travelers do not acquire a contractual right to choose a particular roommate, bedroom, apartment, villa, floor, room number, view, bathroom allocation or other placement within the accommodation.

  3. Where a shared-room or shared-accommodation option applies, personal incompatibility, snoring, different sleeping schedules, hygiene or lifestyle habits, interpersonal disagreements or other personal characteristics of roommates do not by themselves constitute non-conformity of the Package.

  4. The Organizer may change room or property allocation before or during the Tour where reasonably necessary because of property configuration, capacity, family composition, age, gender considerations where appropriate, safety, availability or legitimate group-management requirements.

  5. A preference to stay with or apart from a particular person is treated as a request only unless expressly confirmed.

  6. If a Traveler later requests individual or different accommodation because of personal preference or roommate incompatibility, any alternative is subject to availability and all resulting additional accommodation costs are borne by that Traveler.

  7. Refusal to use accommodation that complies with the agreed Tour configuration is treated as a Traveler-side choice and does not by itself create a contractual financial claim against the Organizer, to the maximum extent permitted by mandatory applicable law.

Section 57.Hotel Room Occupancy, Single Rooms and Upgrades

  1. Unless the Tour Description expressly states otherwise, standard hotel accommodation is based on double or twin rooms.

  2. A Booking containing three or more Travelers, including a family or other persons traveling together, does not by itself create a right to a triple, family or multi-person hotel room.

  3. A triple, family or other multi-person room is provided only where that room type is expressly stated or confirmed for the relevant Tour or Booking.

  4. Where a triple or family room has not been expressly confirmed, Travelers in the same Booking may be allocated between two or more hotel rooms in accordance with availability and the Tour's accommodation model.

  5. A single room, upgraded room or specifically confirmed room configuration may be offered as an Optional Service and is guaranteed only after it has been expressly confirmed and, where applicable, paid for.

  6. Where a confirmed accommodation upgrade or specifically guaranteed configuration becomes unavailable, the appropriate remedy is determined in accordance with the circumstances and applicable law.

Section 58.Accommodation Issues and Temporary Technical Failures

  1. Material accommodation problems should be reported without undue delay both to the accommodation reception or property representative and, where reasonably possible, to the Organizer or Tour Leader so that the issue can be addressed during the stay.

  2. Temporary or isolated technical issues may occur in accommodation, including interruption or variation of hot or cold water, heating, air conditioning, electricity, Wi-Fi, lifts, television, swimming-pool operation, sanitary equipment or other building systems.

  3. Such temporary or isolated issues do not by themselves constitute a material failure of the Package or create a contractual right to compensation or a financial adjustment where they are promptly remedied, are minor in duration or effect, or arise from circumstances outside the Organizer's direct control, to the maximum extent permitted by mandatory applicable law.

  4. The Organizer is not the technical operator of third-party accommodation and must be given a reasonable opportunity, together with the accommodation provider, to seek a practical remedy before any issue is treated as unresolved.

  5. A Traveler who does not report an issue during the stay, despite having a reasonable opportunity to do so, may prevent or materially limit the possibility of remedying it; that circumstance may be taken into account to the extent permitted by applicable law.

  6. A complaint based solely on an unconfirmed preference concerning temperature, mattress firmness, room location, view, bathroom allocation, roommate, décor or similar subjective accommodation expectations does not by itself establish non-conformity.

  7. Where a technical problem is material, persistent and concerns a characteristic expressly included in the Package, any mandatory legal consequences are governed exclusively by applicable law.

Section 59.Baggage

  1. Travelers are responsible for complying with the baggage limits and conditions applicable to the relevant Tour and transport provider.

  2. Travelers are responsible for personally supervising hand luggage, documents, money, electronics, valuables, medicines and other important personal items.

  3. Valuable or fragile items should not be left unattended in a coach, hotel room, luggage compartment or other location not designed for secure storage.

  4. Baggage containers are subject to normal handling, stacking, movement and contact with other luggage during transport.

  5. Ordinary operational wear and tear, including superficial scuffs, minor scratches, stains or similar cosmetic deterioration resulting from normal transport and handling, does not by itself establish Organizer liability where reasonable care has been exercised.

  6. Damage to zippers, handles, straps, wheels or other protruding elements is assessed according to the circumstances, the condition and suitability of the baggage and applicable transport rules and mandatory law.

  7. Baggage-related matters are governed by the conditions applicable to the relevant transport or service and mandatory law.

Section 60.Forgotten or Lost Property

  1. Travelers are responsible for checking that they have collected their belongings when leaving a vehicle, accommodation or other service location.

  2. The Organizer does not guarantee recovery of items forgotten in vehicles, hotels, restaurants or other locations.

  3. Where reasonably possible, the Organizer may assist the Traveler in contacting the relevant provider, but does not undertake to store, collect or return forgotten property.

  4. Any costs associated with recovery, storage or delivery of lost property shall normally be borne by the Traveler.

PART XIV —WEATHER, NATURAL CONDITIONS AND OPTIONAL ACTIVITIES

Section 61.Weather and Natural Conditions

  1. The Organizer does not guarantee snowfall, snow depth, Northern Lights, sunshine, rain, temperature, wind, visibility, wildlife, sea or lake temperature, water clarity, waves or beach conditions unless a specific characteristic is expressly guaranteed.

  2. A winter Tour does not guarantee snow and an island or seaside Tour does not guarantee warm water or bathing conditions.

  3. Natural or weather conditions alone do not constitute improper performance where the material contractual services remain substantially available.

Section 62.Destination Operations and Closures

  1. Restaurants, shops, cafés, seasonal markets, museums, attractions and other third-party or public venues may change hours, close or operate partially because of holidays, weekends, private events, maintenance, staffing, weather, authority decisions or other local circumstances.

  2. Such closure or limited availability does not by itself constitute improper performance unless the relevant venue or service was expressly guaranteed as a material included service.

  3. The Organizer may reasonably adjust sequence, timing or recommendations in response to local conditions.

Section 63.Safety Decisions and Public Restrictions

  1. The Organizer, Tour Leader, driver or relevant provider may make reasonable operational changes required by safety, public restrictions, weather, traffic, authorities, access limitations or other circumstances affecting safe or lawful performance.

  2. Travelers must comply with lawful safety instructions and restrictions applicable at the destination or during transport.

Section 64.Changes Before Departure

  1. The Organizer may make reasonable non-material changes to timing, sequence, route, stops, vehicle allocation, accommodation allocation or other operational details where necessary.

  2. A change that materially affects a principal characteristic of the Package is handled in accordance with mandatory law.

  3. Non-material operational changes do not by themselves alter the applicable cancellation rules.

Section 65.Operational Changes and Substitute Services

  1. During performance, the Organizer may adjust the program or provide a reasonably suitable substitute where the originally planned arrangement cannot reasonably be provided.

  2. Substitute transport, accommodation, timing, route or service format may differ in form while serving the same material purpose.

  3. The use of a suitable substitute does not by itself constitute improper performance merely because it is not identical to the original operational arrangement.

Section 66.Communication of Material Changes

  1. Material changes are communicated through My Trip, email, telephone, messaging, the Tour Leader or another reasonable channel depending on urgency and circumstances.

  2. Travelers are responsible for monitoring the contact details and My Trip information provided for the Booking.

Section 67.Cancellation by the Traveler

  1. The Contracting Person may cancel the Booking before departure through the available cancellation process.

  2. Cancellation is effective when successfully submitted and recorded.

  3. The resulting financial settlement is determined by the Cancellation Policy recorded for the Booking and mandatory law.

Section 68.Standard Cancellation Policy

  1. Unless a different cancellation policy is expressly shown before conclusion of the Agreement, the cancellation fee is calculated from the full Contract Price of the Tour — not from the Prepayment and not from the amount already paid:

    1. 30 days or more before departure — 0% of the full Tour price;

    2. 15–29 days before departure — 50% of the full Tour price;

    3. 8–14 days before departure — 80% of the full Tour price;

    4. 0–7 days before departure — 100% of the full Tour price.

  2. The full Tour price / Contract Price means the total price recorded for the Booking. A Prepayment is only a partial payment toward that total price and does not limit the cancellation fee.

  3. Where the Remaining Balance is payable later — including by card, cash, bank transfer, Stripe payment link or another payment method made available by the Organizer, including payment on or before departure — the cancellation fee is still calculated from the full Tour price.

  4. If the applicable cancellation fee is higher than the amount already paid, the unpaid difference remains payable by the Contracting Person. If the amount already paid exceeds the applicable cancellation fee, the resulting financial settlement is calculated accordingly.

  5. A Tour-specific cancellation policy applies only where it was clearly shown before conclusion of the Agreement and recorded for the Booking.

  6. The cancellation policy recorded for an existing Booking is not changed retroactively.

Section 69.Cancellation Calculation in My Trip

  1. Before final cancellation confirmation, My Trip may display the Contract Price, applicable cancellation fee, amount already paid and the resulting amount remaining payable or to be settled.

  2. The calculation is based on the policy recorded for the Booking and the date and time of cancellation.

  3. Once cancellation is confirmed, that calculation is recorded and is not recalculated merely because a later time band would otherwise apply.

  4. If the cancellation fee exceeds the amount already paid, the difference remains payable.

Section 70.No-Show, Late Arrival and Personal Circumstances

  1. Failure to appear, voluntary non-participation, late arrival or abandonment of the Tour for reasons attributable to the Traveler is subject to the applicable cancellation and non-participation rules.

  2. Illness, work obligations, family circumstances, lack of documents, missed independent transport or other personal circumstances do not automatically alter the Cancellation Policy.

  3. Cancellation insurance, where separately purchased, is governed by its own insurance terms.

Section 71.Minimum Participants

  1. A Tour may require a minimum number of participants.

  2. The applicable minimum and legally required information are stated in the Tour or Booking information where required.

  3. “Tour Confirmed” reflects the current operational status and is not an unconditional guarantee against a later change or cancellation permitted by law.

Section 72.Cancellation by the Organizer

  1. The Organizer may cancel where permitted by mandatory law, including insufficient participants or unavoidable and extraordinary circumstances materially affecting performance.

  2. The Organizer may, where appropriate, offer another departure or alternative Tour, but acceptance of an alternative requires agreement unless mandatory law provides otherwise.

  3. The resulting financial settlement is handled under mandatory law and the Booking record.

Section 73.Unavoidable and Extraordinary Circumstances

  1. Circumstances outside the control of the party invoking them and whose consequences could not reasonably have been avoided may include serious security events, natural disasters, significant transport disruption, authority restrictions, epidemics, border closures or comparable events.

  2. Their legal consequences are determined by mandatory applicable law and the actual effect on performance.

Section 74.Traveler Conduct and Safety

  1. Travelers must behave in a manner that does not threaten safety, materially disrupt the Tour, damage property or seriously interfere with other Travelers, staff, providers or the public.

  2. Travelers must comply with lawful instructions of the Tour Leader, driver, accommodation provider, carrier, guide and other authorized service personnel.

Section 75.Alcohol, Drugs and Prohibited Conduct

  1. Serious intoxication, illegal drugs, violence, threats, harassment, deliberate property damage, dangerous conduct or possession of prohibited items may result in immediate operational measures.

  2. The Traveler bears responsibility for consequences arising from their own unlawful or dangerous conduct to the maximum extent permitted by law.

Section 76.Exclusion from Further Participation

  1. Where a Traveler seriously endangers safety, repeatedly and materially disrupts performance, commits unlawful conduct or refuses essential safety instructions, the Organizer may take proportionate measures, including exclusion from further participation where reasonably necessary.

  2. Any resulting additional transport, accommodation or other costs attributable to the Traveler are borne by that Traveler to the extent permitted by mandatory law.

Section 77.Performance and Materiality

  1. Performance is assessed against the material contractual characteristics expressly recorded for the Booking.

  2. Minor, temporary, isolated or subjective deviations that do not materially impair an agreed service do not by themselves constitute improper performance.

  3. Where a material issue is reported, the Organizer may correct the service, change the operational arrangement, provide a suitable alternative or take another reasonable measure.

  4. The Organizer is not required to take a measure that is impossible or disproportionately burdensome where mandatory law permits such limitation.

Section 78.Alternative Arrangements During the Tour

  1. Where a material included service cannot be provided as originally planned, the Organizer may provide an appropriate operational alternative where reasonably possible.

  2. The alternative may differ in form provided that it remains reasonably comparable in material purpose and character.

  3. Legal consequences that cannot be resolved operationally are determined by mandatory applicable law.

Section 79.Limits of Liability

  1. Liability is subject to the limitations, exclusions, allocation of responsibility and applicable international conventions permitted by law.

  2. To the maximum extent permitted by mandatory law, monetary liability for damage other than personal injury or damage caused intentionally or through negligence is limited to three times the total price of the Package.

  3. The following, where minor, temporary, isolated, promptly remedied, outside the Organizer's direct control, based on subjective preference or not materially affecting an expressly agreed service, do not by themselves establish a basis for a financial claim:

    1. temporary interruption or reduced efficiency of air conditioning, heating, water, electricity, Wi-Fi, television, lifts, pools or other accommodation systems;

    2. temporary technical defects where a reasonable opportunity to remedy them is provided;

    3. subjective dissatisfaction with room temperature, mattress, interior, room location, view, bathroom allocation, roommate or ordinary location noise;

    4. snoring, different sleeping schedules, personal habits, lifestyle differences or interpersonal disagreement in shared accommodation;

    5. queues, crowds, traffic, roadworks, construction, demonstrations, public events, seasonal congestion or access restrictions;

    6. different opening hours or closure of non-guaranteed third-party venues;

    7. weather or natural conditions, including lack of snow, rain, heat, cold, wind, fog, sea temperature, waves, water clarity, lack of Northern Lights or wildlife;

    8. permitted non-material changes of timing, route order, stops, vehicle allocation, seating or room allocation;

    9. subjective perception of a Tour Leader, guide, commentary, route narrative, excursion style, entertainment value, social atmosphere or group composition;

    10. differences between illustrative promotional material and actual non-guaranteed visual circumstances;

    11. reasonable waiting connected with transfers, substitute transportation, group coordination, borders, traffic or operational changes;

    12. any comparable minor inconvenience, personal preference, subjective expectation or non-material deviation.

  4. The Traveler should report a potentially material issue without undue delay and allow a reasonable opportunity to address it where possible.

  5. Amounts provided by another responsible entity for the same event may be taken into account to prevent double recovery where permitted by law.

  6. Nothing excludes or limits liability where mandatory law prohibits such limitation.

Section 80.Circumstances Attributable to the Traveler

  1. The Organizer is not responsible, to the maximum extent permitted by mandatory law, for consequences caused by the Traveler's own acts or omissions, including lack of documents, lateness, missed independent transport, prohibited items, failure to follow safety instructions, voluntary non-participation or independently arranged activities.

  2. The Traveler bears reasonable additional costs resulting from such circumstances unless mandatory law provides otherwise.

Section 81.Travel Insurance

  1. Time Travel, on the basis of the general insurance agreement concluded with SIGNAL IDUNA Polska Towarzystwo Ubezpieczeń S.A., General Agreement No. 517424 dated 27 January 2020, arranges insurance for its customers in accordance with applicable law.

  2. As the Tours covered by these Terms take place outside Poland, the applicable insurance is SIGNAL IDUNA Bezpieczne Podróże. The selected insurance variant, territorial scope, sums insured and any selected extensions are stated in the Booking, My Trip or the relevant insurance documentation.

  3. Before the Traveler is covered by or purchases an insurance option, the applicable insurance information, including the relevant IPID, insurance terms (OWU), selected variant, scope of cover, sums insured and material exclusions or extensions, is made available in a form permitted by applicable law.

  4. The insurance documentation applicable to the relevant Booking is retained or made available in My Trip so that the Contracting Person and Travelers can access and reproduce the information applicable to their insurance.

  5. The applicable insurance is governed exclusively by the SIGNAL IDUNA insurance terms and insurance documentation recorded for the relevant Booking.

  6. The 24-hour SIGNAL IDUNA Emergency Assistance Centre is available at +48 22 864 55 26 and CentralaAlarmowa@signal-iduna.pl.

Section 82.Additional and Cancellation Insurance

  1. Where available during Booking, the Traveler may purchase additional insurance for an additional fee, including:

    1. Europa Super — costs of medical treatment and assistance (KL) up to EUR 60,000;

    2. Świat Super — costs of medical treatment and assistance (KL) up to EUR 100,000; and

    3. SIGNAL IDUNA Bezpieczne Rezerwacje cancellation/interruption insurance, where offered for the relevant Booking.

  2. The exact scope of cover, selected variant, insured sum, exclusions, extensions and other applicable conditions are determined by the insurer's IPID, OWU and insurance documentation for the selected option.

  3. Before purchase of an additional insurance option, the applicable IPID and OWU and information on the selected scope and insured sum are made available to the Contracting Person in accordance with applicable law.

  4. After purchase, the insurance documentation applicable to the selected option is retained or made available in My Trip for the relevant Booking.

  5. Purchase of cancellation insurance does not modify, suspend, replace or reduce the payment obligations arising under the Agreement or the applicable Cancellation Policy.

  6. Where the cancellation fee calculated under the applicable Cancellation Policy exceeds the amount already paid to Time Travel, the outstanding difference remains payable by the Contracting Person. Insurance coverage does not suspend this payment obligation.

  7. Following cancellation, Time Travel may provide the documents reasonably required by the insurer, including confirmation of the Tour price, cancellation, amounts actually paid and the applicable cancellation fee or deductions.

  8. Where proof of payment or full financial settlement is required for the insurance claim, the relevant confirmation is issued after the corresponding amount has actually been paid to Time Travel.

  9. The Traveler submits any insurance claim directly to SIGNAL IDUNA or the relevant insurer and is responsible for complying with the insurer's claim procedure, deadlines and documentation requirements.

  10. Time Travel does not determine whether an insurance claim will be accepted or the amount payable by the insurer.

  11. Cancellation insurance does not cover cancellation merely because the Traveler changes plans or for another reason not covered by the applicable insurance terms.

  12. Where coverage for an exacerbation of a chronic illness is required under Bezpieczne Rezerwacje, the relevant additional chronic-illness extension must be included if required by the insurer's terms.

Section 83.Insurance Events and Claims

  1. In the event of illness, accident or another insured event, the Traveler must follow the applicable insurer's procedure and contact SIGNAL IDUNA or the Emergency Assistance Centre where required by the insurance terms.

  2. In the case of Bezpieczne Rezerwacje, the Traveler should promptly notify Time Travel of the cancellation or interruption and submit the insurance claim directly to SIGNAL IDUNA together with the documents required by the insurer.

  3. Time Travel may provide documents relating to the Booking that are reasonably required for the insurance claim, including confirmation of the Booking, Tour price, cancellation and the applicable cancellation fee or deductions.

  4. Any insurance payment, reimbursement or coverage decision is made by SIGNAL IDUNA in accordance with the applicable insurance terms.

  5. Time Travel may provide practical assistance with Booking-related documentation but does not submit the insurance claim on the Traveler's behalf and does not decide whether an insured event is covered.

Section 84.Insolvency Protection, TFG and TFP

  1. The Organizer maintains the insolvency protection required by Polish law.

  2. Contributions to the Turystyczny Fundusz Gwarancyjny (TFG) and Turystyczny Fundusz Pomocowy (TFP) are handled in accordance with applicable law.

  3. Current guarantee and protection information is provided in the legally required documentation and is not permanently hard-coded into these Terms where it may change during their validity.

Section 85.Reporting Problems During the Tour

  1. A Traveler should report a material problem without undue delay to the Tour Leader, Organizer or relevant provider so that it can be assessed and, where possible, addressed during the Tour.

  2. Failure to provide a reasonable opportunity to address an issue may be taken into account to the extent permitted by mandatory law.

Section 86.Complaints

  1. A complaint concerning a service for which the Organizer is legally responsible may be submitted electronically or through another channel made available by the Organizer.

  2. It should, where possible, identify the Booking, Traveler, issue, relevant date and circumstances and include relevant supporting material.

  3. Complaints are reviewed and answered without undue delay and within any period expressly required by mandatory applicable law.

  4. Failure to respond has only the consequences that follow directly from mandatory law; these Terms create no additional presumption of acceptance or admission.

  5. Submission of a complaint does not by itself establish improper performance or that any financial amount is due.

Section 87.Independent Services and Traveler Assistance

  1. Issues concerning services purchased independently from third parties are handled directly with the relevant provider.

  2. Where a Traveler is in difficulty during the Tour, the Organizer provides assistance to the extent required by mandatory law and may provide additional practical assistance where reasonably possible.

Section 88.My Trip

  1. My Trip is the primary digital area for the Booking, contractual information, payment status, Travelers, documents, operational updates and other Booking-specific information.

Section 91.Legal Revision and Historical Record

Section 92.Language Versions

  3. Disputes are resolved by the competent court determined under applicable law.

Section 95.No Waiver and Entry into Force
